Public consultation on transposition of the revised European Tobacco Products Directive (2014/40/EU)

The Department of Health is seeking views on the transposition of the revised European Tobacco Products Directive (2014/40/EU). The aim of the Directive is to harmonise laws on tobacco products and electronic cigarettes, to facilitate the smooth functioning of the internal market while assuring a high level of public health protection.  Areas regulated by the Directive include labelling and packaging, ingredients and emissions, traceability and security features and cross border distance sales of tobacco products and electronic cigarettes.

The mandatory requirements of the Directive must be transposed by Member States into their national legislation.  Within a number of those mandatory requirements Member States may determine certain discretionary elements.  The consultation focuses on those discretionary elements.

A consultation paper providing details of the discretionary elements and a preview of the questions contained in the online questionnaire is available to download here.  It is recommended that you read the consultation paper prior to commencing the online questionnaire.

Only views submitted using the online questionnaire will be included in the consultation process.  Please note that the questionnaire must be completed in one session.  If you would prefer to prepare your response in advance of making the online submission, it is possible to copy and paste material from a Word document.

The questionnaire was open until 5pm on Wednesday, 18th November 2015 and is now closed.

All submissions received by the Department are subject to the Freedom of Information (FOI) Act 2014 and may be released in response to an FOI request. The Department publishes responses to FOI requests online.
